In October 2022, the U.S. Customs Service initiated the Modernization of the Customs Broker<\/strong> Regulations 19 CFR 111. This helps optimize U.S. Customs and Border Protection (CBP) resources. <\/p>\n\n\n\n

This modernization updates compliance requirements to protect imports<\/strong> and increase CBP’s knowledge of importers and merchandise. <\/p>\n\n\n\n

The main update is reflected in the way the power of attorney (POA)<\/strong> is configured in relation to the DDP Incoterms. With any new AOP, direct communication from the requesting foreign customer to the Customs team is required. The modernization of these regulations means that U.S. customs<\/a><\/strong> no longer allows AOPs to be set up through a third party, such as a freight forwarder or other unlicensed user or company. <\/p>\n\n\n\n

In addition, brokers must<\/a><\/strong> now designate a knowledgeable point of contact to be available to CBP 24 hours a day, seven days a week to respond to any incidents and commercial customs issues that may arise. This is called the 24\/7 POC<\/strong>. <\/p>\n\n\n\n

In addition, all AOPs that commenced operations before December 19, 2022, must be confirmed in writing<\/strong> by the company making the application.<\/p>\n\n\n\n
